Terms and Conditions

IMPORTANT NOTICE:

This document is an electronic record in terms of the Information Technology Act, 2000 and the applicable rules made thereunder. It does not require any physical or digital signatures. If this document is not in a language you understand, please contact Zumy for clarification. Your acceptance of this agreement by clicking on the 'I Accept' button or by continuing to use our Platform shall be deemed to be your acceptance of these Terms and Conditions.

1. Definitions and Interpretation

  • "Zumy" refers to the service platform operated by Zumy Labs Private Limited.
  • "Platform" means the Zumy mobile application and website.
  • "User" refers to you, the individual or business who uses the Platform to request delivery services.
  • "Delivery Partner" or "Runner" means independent individuals or entities registered on the Platform to provide delivery services.
  • "Delivery Task" means a specific delivery request created by a User.
  • "Zumy Parcel" refers to the intra-city parcel and document pick-up and drop service offered on the Platform.
  • "Zumy Food" refers to the on-demand food ordering and delivery service offered on the Platform, through which Users can place food orders from listed Restaurant Partners.
  • "Restaurant Partner" means a food establishment registered with Zumy to offer its menu items for ordering through the Platform.
  • "Food Order" means a request placed by a User through Zumy Food to purchase food items from a Restaurant Partner.

2. Service Overview and User Responsibilities

  • Zumy provides a technology platform connecting Users with Delivery Partners and Restaurant Partners to fulfill on-demand delivery services under two verticals: Zumy Parcel and Zumy Food.
  • Zumy Labs Private Limited acts solely as a facilitator and does not directly provide logistics, courier, or food preparation services.
  • Users must be at least 18 years old to use the service.
  • Users are responsible for:
    • Providing accurate pickup and drop-off or delivery address information
    • Correctly packing and labeling items for safe transport (for parcels)
    • Ensuring items and orders comply with applicable policies
    • Making timely payments for services
  • Users agree not to use the Platform for transporting prohibited, illegal, hazardous, or restricted items including narcotics, arms, ammunition, flammable substances, currency, securities, precious metals, biological materials, human or animal remains, pornographic content, contraband, explosives, fuels, hazardous materials, pesticides, waste, firearms, ammunition, illegal substances, stolen goods, alcohol and drugs.
  • Zumy reserves the right to report suspicious activities to appropriate law enforcement authorities.

3. Zumy Food — Food Ordering and Delivery

3.1 Nature of Service

Zumy Food enables Users to browse menus, place food orders, and receive delivery from Restaurant Partners through the Platform. Zumy acts solely as a technology intermediary and is not responsible for the preparation, quality, hygiene, taste, or nutritional content of any food items.

3.2 Restaurant Partner Responsibility

Restaurant Partners bear full responsibility for the accuracy of menu listings, food quality, portion sizes, ingredients, allergen information, and compliance with applicable FSSAI and food safety regulations.

3.3 Order Placement and Acceptance

A Food Order is considered confirmed once the Restaurant Partner accepts it on the Platform. Zumy reserves the right to cancel an order on behalf of the Restaurant Partner if it cannot be fulfilled. Estimated delivery times are indicative only.

3.4 Cancellation Policy for Food Orders

Users may cancel a Food Order only before it has been accepted by the Restaurant Partner, and will receive a full automatic refund. Once a Restaurant Partner has accepted the order, cancellations are not permitted.

3.5 Delivery and Delays

Delivery is performed by Delivery Partners (Runners) registered on the Platform. Zumy is not liable for delays caused by traffic conditions, weather, restaurant preparation time, or other factors outside its control.

3.6 Non-Delivery

If a confirmed Food Order is not delivered due to reasons attributable to Zumy or the Delivery Partner, Users will be eligible for a full refund. Non-delivery due to incorrect address information provided by the User will not be eligible for a refund.

4. Pricing and Payment

  • Service charges for Zumy Parcel are calculated based on distance, item size, time, and special handling requirements.
  • Food Order pricing reflects the menu prices set by Restaurant Partners, plus applicable delivery and platform fees displayed at checkout.
  • Payment must be made via authorized payment methods on the Platform.
  • Zumy offers Cash on Pickup and Cash on Delivery options subject to availability.

5. Refund and Cancellation Policy

Zumy Parcel

  • Cancellations made before acceptance by a Delivery Partner receive a full automatic refund.
  • Cancellation fees may apply if the task has already been accepted.
  • Full refunds for errors attributable to Zumy or force majeure.

Zumy Food

  • Full automatic refund if cancelled before Restaurant Partner acceptance.
  • No cancellations/refunds once accepted, except for non-delivery attributable to Zumy/Runner.
  • Quality issues must be raised within 24 hours of delivery.

Refunds will be processed within 1–3 business days to the original payment method.

6. User Obligations

Account Security

Maintain account confidentiality, use strong passwords, and report unauthorized access promptly.

Delivery and Order Tasks

Provide accurate addresses, ensure item safety/packaging (for parcels), and be available during delivery windows.

Prohibited Activities

Misrepresenting item content, providing false information, harassment of partners, or illegal use of the platform.

7. Limitation of Liability

Zumy disclaims all warranties of merchantability or fitness. Zumy is not responsible for traffic delays, improper packaging damage, loss from incorrect info, or food quality issues attributable to Restaurant Partners. Maximum liability is limited to the value of the service fee paid for the specific transaction.

8. Privacy and Data Usage

Users agree to data collection and usage as per the Zumy Privacy Policy for service facilitation, support, compliance, and improvements.

9. Termination

Zumy may suspend or terminate access for breach of terms, legal directives, abuse, fraud, or non-payment.

10. Dispute Resolution

All disputes shall be resolved through arbitration in Bengaluru, Karnataka, in accordance with the Arbitration and Conciliation Act, 1996.

11. Amendments

Zumy reserves the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance.
