THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF THE INFORMATION TECHNOLOGY ACT, 2000 AND THE APPLICABLE RULES MADE THEREUNDER. IT DOES NOT REQUIRE ANY PHYSICAL OR DIGITAL SIGNATURES. YOUR ACCEPTANCE OF THIS AGREEMENT BY CLICKING ON THE 'I ACCEPT' BUTTON OR BY CONTINUING TO USE OUR PLATFORM SHALL BE DEEMED TO BE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

1. DEFINITIONS AND INTERPRETATION

  • "Zumy" refers to the service platform operated by Aalpha Information Systems India Pvt Ltd.
  • "Platform" means the Zumy mobile application and website.
  • "User" refers to individuals or businesses who use the Platform to request item pick-up and drop services.
  • "Delivery Partner" or "Runner" means independent individuals or entities registered on the Platform to provide delivery services.

2. TERMS OF USE

  1. Zumy provides a technology platform to connect Users with Delivery Partners to fulfill on-demand delivery services.
  2. Aalpha Information Systems India Pvt Ltd acts solely as a facilitator and does not provide logistics or courier services.
  3. Users are responsible for correctly packing and labeling their items for safe transport.
  4. Delivery Partners operate independently and are not employees, agents, or representatives of Zumy.
  5. Acceptance of a task by a Delivery Partner constitutes an independent agreement between the User and the Delivery Partner.
  6. Zumy shall not be liable for any delay, damage, theft, or non-performance of services by Delivery Partners.
  7. Users agree not to use the Platform for transporting prohibited, illegal, hazardous, or restricted items as per Indian laws, including but not limited to:
    • Narcotics, arms, ammunition, flammable substances
    • Currency, securities, precious metals/stones
    • Biological materials, human or animal remains
    • Pornographic content, contraband
    • Explosives, fuels, hazardous materials, pesticides, waste
    • Firearms, ammunition, illegal substances, stolen goods
    • Alcohol and drugs
  8. Zumy reserves the right to report suspicious activities to appropriate law enforcement authorities.

3. SERVICE FEES AND PAYMENTS

  1. Users shall pay applicable service charges at the time of booking a Delivery Task. Zumy also offers Cash on Pickup and Cash on Delivery options subject to availability and location-specific constraints. These options may involve additional handling fees as disclosed on the Platform during task confirmation.
  2. Payment must be made via authorized payment methods on the Platform.
  3. Delivery of the item will only be completed upon full payment.
  4. Cancellation is only permitted before a Delivery Task has been accepted by a Delivery Partner. Once accepted, cancellations are not allowed and the User may be charged the full service fee.

4. USER OBLIGATIONS

  1. Users must provide accurate pickup and drop-off details.
  2. Users must ensure that the items to be delivered comply with applicable laws.
  3. Users agree not to misrepresent item content, size, or value.
  4. Users agree not to hold Zumy liable for any misdelivery due to incorrect information.

5. DELIVERY PARTNER RELATIONSHIP

  1. Delivery Partners are onboarded on a principal-to-principal, voluntary basis.
  2. No employer-employee or principal-agent relationship exists between Zumy and any Delivery Partner.
  3. Delivery Partners are solely responsible for their taxes, insurance, and compliance under applicable Indian labour laws.

6. LIMITATION OF LIABILITY

  1. Zumy disclaims all warranties of merchantability, fitness for a particular purpose, or non-infringement.
  2. Zumy shall not be responsible for indirect, incidental, or consequential damages.
  3. Maximum liability of Zumy in any case shall be limited to the value of the service fee paid.

7. PRIVACY AND DATA USAGE

  1. Users agree to the collection, processing, and storage of their personal and location data as per the Zumy Privacy Policy.
  2. Such data is used for service facilitation, customer support, and legal compliance.

8. TERMINATION

Zumy may suspend or terminate access to the Platform in the event of:

  • Breach of these terms by User or Delivery Partner
  • Legal or regulatory directive
  • Abuse or fraudulent use of the Platform

9. INDEMNIFICATION

Users and Delivery Partners agree to indemnify, defend, and hold harmless Zumy, its parent company Aalpha Information Systems India Pvt Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or in any way connected with:

  • The use or misuse of the Platform
  • Violation of any terms of this Agreement
  • Any misrepresentation or breach of applicable laws or regulations
  • Delivery of prohibited or restricted items
  • Any third-party claims arising from transactions facilitated by the Platform

10. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any disputes arising under this Agreement.

11. AMENDMENTS

Zumy reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of the updated terms.
