THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF THE INFORMATION TECHNOLOGY ACT, 2000 AND THE APPLICABLE RULES MADE THEREUNDER. IT DOES NOT REQUIRE ANY PHYSICAL OR DIGITAL SIGNATURES. YOUR ACCEPTANCE OF THIS AGREEMENT BY CLICKING ON THE 'I ACCEPT' BUTTON OR BY CONTINUING TO USE OUR PLATFORM SHALL BE DEEMED TO BE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

1. DEFINITIONS AND INTERPRETATION

  • "Zumy" refers to the service platform operated by Aalpha Information Systems India Pvt Ltd.
  • "Platform" means the Zumy mobile application and website.
  • "User" refers to you, the individual or business who uses the Platform to request item pick-up and drop services.
  • "Delivery Partner" or "Runner" means independent individuals or entities registered on the Platform to provide delivery services.
  • "Delivery Task" means a specific delivery request created by a User.

2. SERVICE OVERVIEW AND USER RESPONSIBILITIES

  1. Zumy provides a technology platform to connect Users with Delivery Partners to fulfill on-demand delivery services.
  2. Aalpha Information Systems India Pvt Ltd acts solely as a facilitator and does not provide logistics or courier services.
  3. Users must be at least 18 years old to use the service.
  4. Users are responsible for:
    • Providing accurate pickup and drop-off information
    • Correctly packing and labeling items for safe transport
    • Ensuring items comply with our permitted items policy
    • Making timely payments for services
  5. Users agree not to use the Platform for transporting prohibited, illegal, hazardous, or restricted items as per Indian laws, including but not limited to:
    • Narcotics, arms, ammunition, flammable substances
    • Currency, securities, precious metals/stones
    • Biological materials, human or animal remains
    • Pornographic content, contraband
    • Explosives, fuels, hazardous materials, pesticides, waste
    • Firearms, ammunition, illegal substances, stolen goods
    • Alcohol and drugs
  6. Zumy reserves the right to report suspicious activities to appropriate law enforcement authorities.

3. PRICING AND PAYMENT

  1. Service charges are calculated based on:
    • Distance between pickup and drop locations
    • Type and size of items
    • Time of delivery request
    • Special handling requirements
  2. Payment must be made via authorized payment methods on the Platform.
  3. Zumy offers Cash on Pickup and Cash on Delivery options subject to availability.

4. REFUND AND CANCELLATION POLICY

  1. Cancellations must be made before a Delivery Task has been accepted by a Delivery Partner to receive a full refund Automatically.
  2. Cancellation fees may apply if the task has been accepted by a Delivery Partner.
  3. If a delivery service is not performed due to our error or force majeure events, customers are eligible for a full refund.
  4. Refunds will be processed within 1-3 business days to the original payment method.
  5. For refund requests or disputes, please contact our support team at support@zumy.in with your order details.

5. USER OBLIGATIONS

  1. Account Security:
    • Maintain account confidentiality
    • Use strong passwords
    • Report unauthorized access
    • Not share account credentials
  2. Delivery Tasks:
    • Provide accurate pickup and drop-off details
    • Ensure item safety and proper packaging
    • Be available during scheduled pickup/delivery times
    • Respond to delivery-related communications
  3. Prohibited Activities:
    • Misrepresenting item content or value
    • Providing false information
    • Harassing Delivery Partners
    • Using the service for illegal purposes

6. LIMITATION OF LIABILITY

  1. Zumy disclaims all warranties of merchantability, fitness for a particular purpose, or non-infringement.
  2. Zumy shall not be responsible for:
    • Delays due to traffic or unforeseen circumstances
    • Damage due to improper packaging
    • Loss due to incorrect delivery information
    • Force majeure events
  3. Maximum liability of Zumy in any case shall be limited to the value of the service fee paid.

7. PRIVACY AND DATA USAGE

  1. Users agree to the collection, processing, and storage of their personal and location data as per the Zumy Privacy Policy.
  2. Such data is used for:
    • Service facilitation
    • Customer support
    • Legal compliance
    • Service improvements

8. TERMINATION

Zumy may suspend or terminate access to the Platform in the event of:

  • Breach of these terms
  • Legal or regulatory directive
  • Abuse or fraudulent use of the Platform
  • Non-payment of dues

9. DISPUTE RESOLUTION

All disputes shall be resolved through arbitration in Bengaluru, Karnataka, in accordance with the Arbitration and Conciliation Act, 1996.

10. AMENDMENTS

Zumy reserves the right to amend or update these Terms at any time. Continued use of the Platform constitutes acceptance of the modified terms.
